Notes on the use of FX-only VPS (Windows)

 Please do not use Task Manager to terminate a process task for the purpose of saving memory. Doing so will cause the virtual machine to black out or blue out and not run properly.  Never change the network settings of the virtual machine. If you do, remote desktop connection will not be possible.  Please refrain from any activity that places an excessive burden on the line. In order to prevent damage to other customers, we may terminate your service without prior warning as soon as it is discovered.  Please do not use this server for mass spamming or unauthorized access activities.  Do not transfer or give away your account information.  Please do not perform task termination of processes from Task Manager for the purpose of saving memory. Doing so will cause the virtual machine to black out or blue out and not run properly.

Terms of Use

These Virtual Desktop Terms of Use (hereinafter referred to as the "Terms") apply to services provided by Best One Co. The Company may change these Terms of Use in accordance with various circumstances, including actual customer usage and social conditions. In the event of modification of the Terms and Conditions, the latest version of the Terms and Conditions after modification shall be binding on the Company and the customer. In the event of a change in the Terms of Use, the Company shall notify the customer of the change by e-mail, in writing, on the web page, or by any other means of communication that the Company deems appropriate. However, even if no notice is received, the revised Terms of Service shall apply. Definition of Service The term "Service" as used herein refers to the virtual desktop service and related services (hereinafter referred to as "Service") provided by the Company to the customer. ________________________________________ Article 2 Terms of Service The contract for the use of the Service shall be based on the terms and conditions set forth below, which shall be applied for through GogoJungle (hereinafter referred to as "GogoJungle Market"), an e-commerce platform service operated by GogoJungle, Inc. (hereinafter referred to as "GogoJungle Market"), and the Company receives and accepts the application from the customer. The Company may not accept an application for the use of the service in the following cases. 1. 1. when a false statement of fact is made in the application; 2. when a customer fails to fulfill his/her obligations under the Usage Contract 2. when the Company deems that the Customer may fail to fulfill its obligations under the Usage Contract; or 3. when the Company deems that the Customer may fail to fulfill its obligations under the Usage Contract. (3) When the customer has had all service use contracts with the Company forcibly terminated in the past. (4) When a competitor of the Company, etc. has cancelled the service contract. (4) When it is found that a competitor of the Company has entered into a contract with the Company for the purpose of business investigation, or the Company otherwise deems it inappropriate to enter into a contract with the Customer; (5) When the Company otherwise deems it inappropriate to enter into a contract with the Customer (5) When the Company otherwise deems it inappropriate to enter into a contract. ________________________________________ Article 3 Starting Date of Use - The starting date of service use is defined as the date when the application is received from GogoJungle Market Shopping Cart. However, if the Company does not accept the contract or does not deliver the account information required to start using the service in accordance with Article 2, no fees will be incurred during that period. ________________________________________ Article 4 Minimum Contract Period The minimum contract period for this service agreement is one month. ________________________________________ Article 5 Definition of one contract unit When you apply for one of our products listed on GogoJungle Market, it is defined as one contract. Article 6 Binding by Price List You and the Company shall be bound by the price listed on the product page of the products we list on GogoJungle Market. Other matters shall be in accordance with the GogoJungle Market Terms of Service. The Company may temporarily stop providing the service in the following cases. When the Company has no choice but to suspend the service due to maintenance, inspection, or construction of the Company's telecommunication facilities. When there is an unavoidable failure of our telecommunication facilities. When it becomes difficult to provide the service for some reason. In the event of temporary suspension of service provision pursuant to the preceding paragraph, the Company will notify the customer in advance via the Web page or e-mail of the timing, duration, and reason for the suspension. Suspension of Service under the Regulations We may suspend the provision of service without prior notice or recommendation if any of the following circumstances applies to the customer's use of the service. Article 10 Discontinuation of Service This service may be discontinued at the Company's convenience or due to unavoidable circumstances. Information such as user IDs and passwords must not be disclosed to outside parties, and subscribers are responsible for managing their passwords. If the Subscriber loses such information and fails to notify the Company of such loss. 6. In the event that the Subscriber performs an act that seriously affects other Subscribers or the Company, or causes a load on the server, lines, etc. 7. In the event that a subscriber transfers or resells the content to a third party without the Company's permission. 8、Intellectual property infringing contents are uploaded to the virtual desktop. 9. If the basic network settings such as IP address, DNS server, gateway, host name, etc. are changed. Article 13 Disclaimer We shall not be liable for any damages incurred by you as a result of use, temporary suspension, suspension, emergency suspension, discontinuation, or termination of the service or contract, except as provided in the following provisions. 1. If the Subscriber suffers damages because all or part of the service is completely unavailable due to intentional or gross negligence on the part of the Company, only if such unavailability continues for 24 hours, the Company shall be liable for the amount calculated by dividing the number of hours of unavailability by 24 (rounding down any fractional part) by 1/30 of the virtual desktop usage fee The amount of such damages shall be applied to the following month's virtual desktop usage fee by reducing it. 2. In the event of any disadvantage or damage to the subscriber other than as provided in these Terms and Conditions, the Company shall, upon mutual consultation, compensate the customer for up to 6 months' worth of FX-dedicated virtual desktop usage fee to be borne by the customer, provided that such damage is directly caused by the intentional act or gross negligence of the Company and the customer has presented the Company with documentary evidence to prove the amount of such damage. In such case, the Company shall accept your claim for compensation based on the actual direct damages incurred by you up to six (6) months' worth of FX Virtual Desktop Usage Fees. 3. In the event of legal disputes, or in the event of a request from an investigative agency, the Company may conduct an audit of the inside of a virtual desktop that is being used by a Customer or that has been terminated. Article 14 Agreed Jurisdiction If any dispute arises between the Company and the customer, the agreed jurisdiction shall be the Sendai District Court, Furukawa Branch.
